(Assignee) For Commission Consent to the Assignment of License of FM Translator Station W238CE, Montgomery, Alabama ORDER Issued: June 21, 2016 Released: June 21, 2016 On June 8, 2016, the Presiding Judge issued Order, FCC 16M-19, in which he directed the parties to submit a deposition schedule by the close of business on Friday, June 10, 2016. Id. at 2. On June 10, the schedule never arrived. Instead, parties submitted a joint request for an extension of time. Evidently, the parties were only able to agree to a "time frame" for taking the depositions, but were not "able to confirm the availability of witnesses or the logistical details.. ." Joint Request at 1. The parties stated that they have agreed to the week of September 12, 2016 as their "time frame" for taking depositions. Id. The Presiding Judge obviously is displeased that this case has taken so long merely to set dates, and that depositions are not expected to take place for three months hence. As requested, September 16, 2016, shall be the date on which all depositions shall be concluded, including deposing, transcription, and review for error. There shall be no further extension. In the case that any depositions need to be rescheduled due to deponents' unavailability, the Judge directs counsel to use every effort to find timely dates.
