Title 2 oversight of ISPs is providing an adequate minimum protection from the ISPs. There might not be any evidence that ISP's behavior will change towards exploitation of title 1, (other than the Verizon lawsuit to ursurpt it, that initiated the title 2 classification in the first place...), which should not be an argument to reclassify ISP oversight of Title 2. If there is no behavior towards such exploitation, as Pai said, then the oversight should not be a problem and simply protect net nutrality for the consumers.
